United Family Online Self-Service End User License Agreement (EULA)

和睦家医疗依据本协议为用户（以下简称"您"）提供线上自助服务。本协议对您和和睦家医疗旗下全部的医院和诊所（以下简称"本公司"）均具有法律约束力。

在使用和睦家医疗提供的线上自助服务前，您应当阅读并遵守本协议、以及认真阅读将来使用中的系统提示，服务的访问方式包括和睦家医疗集团的网站，微信公众号，微网站，手机客户端等。在此特别提醒您认真阅读并充分理解本协议和附属协议各条款，特别是免除或限制本公司的责任、限制您的权利、规定争议解决方式的相关条款。请您审慎阅读并选择是否接受本协议和附属协议（未成年人应在监护人陪同下阅读）。除非您接受本协议的所有条款，否则您无权使用在线自助服务功能。您一经开通或使用和睦家医疗在线自助服务功能，即视为您已理解并接受本协议。

In accordance with this agreement, United Family Healthcare agrees to provide end users of this software, (hereinafter referred to as "you") with all self-service medical information-related services provided within this online software platform. This agreement is legally binding on you and on all hospitals and clinics legally registered by United Family Healthcare (UFH), (hereinafter referred to as "the Company").

Before using the online self-service patient portal software provided by the Company, you should carefully read and abide by this entire agreement. During use, you should pay attention to all system notices and follow them accordingly. System platforms used by you in the course of utilizing this service may include the United Family Healthcare website and all sub-websites, UFH mini-websites, the UFH official WeChat account, the UFH mobile platform and text notices, as well as a variety of other software and communications platforms associated with the Company for use with this software. You are specifically reminded to carefully read and fully understand the terms of this agreement, and all subsidiary agreements herein. Upon recognition of your agreement to these terms, you specifically agree to waive or limit the liability of the Company and limit your right to stipulate the terms of dispute resolution. Please read carefully and choose whether to accept this agreement and the related agreements herein. (Please note that if you are a minor in the Chinese legal sense, a legal adult guardian must accompany you to read, understand, and authorize your consent in agreeing to these terms). You are not authorized to use the online self-service features included in this software unless you formally accept all the terms of this agreement. You will be considered to have understood and accepted this agreement and be responsible for all those added or bound to your account once you or they have clicked a check in the box that says "I have read and agree" and then subsequently opened or have begun using the software platform.

第一条【在线自助服务】

Article 1) Online Self-service

1.1

在线自助服务是睦家医疗通过官方网站，微信公众号，微网站，手机客户端提供给用户自助完成在线注册，预约，查询检查结果，健康管理，健康评估，账单查询和账单支付等自助服务功能。

1.1

Online self service is provided by United Family Healthcare (UFH) through its official website and all sub-websites, UFH mini-websites, the UFH WeChat official account, the UFH mobile platform and text notices, as well as a variety of other software and communications platforms associated the company. Once initially registered with a UFH facility, you may engage in self-service online patient platform registration, make online appointments, enquire about patient lab reports, see invoices, billing, make online payments, and engage in a range of other services.

1.2

您理解并同意，本服务的上述流程，可能因适用场景和功能存续情况的变化而发生调整，所以具体以和睦家医疗实际提供的服务流程为准。

1.2

You hereby understand and agree that, from time to time, the company may make adjustments to any or all online services mentioned above on the platform as necessary, and that continued upgrades and changes may be likely.

1.3

您同意并授权和睦家医疗通过在线的方式向您本人或您在授权书上规定的医疗代理人提供相应的服务。这些服务将会展示相应信息，如身份信息、病历号，检查结果，账单记录等。

1.3

You hereby agree and authorize the company to provide the appropriate services to you, or to the patient bound to your account as specified by through your online authorization on the platform. To provide online services on this platform, you may be asked to provide relevant information and the company may need to display online information to your private account, such as identity information, medical record number, health assessment lab results, invoices, billing records, and other personal information.

1.4

您理解并同意，和睦家医疗有权根据业务运营的调整，单方修改或变更本协议的内容，并将通过以上提及的访问方式公布最新的服务协议，本公司将不另作个別通知。若您于本协议或附属协议发生任何修改或变更后继续使用本服务，则视为您已阅读、了解并同意接受上述修改或变更，若您不同意上述修改或变更，应立即停用本服务。

1.4

By demonstrating online here through your acceptance of this agreement, you hereby declare that you agree and understand that United Family Healthcare reserves the right to modify or change the contents of this agreement unilaterally, in accordance with any changes in business operations, and will publish the latest updated service agreement through one or all of the abovementioned communications channels, but will not make any other individual notice on any other platform. Should you decide to continue to use this online service after any modifications or changes to this agreement or related agreements upon publishing the updated agreement notification with changes, you are thereby deemed to have read, understood and agreed to accept the above modifications or changes. If you do not agree to the above modifications or changes, you should immediately discontinue the online service.

第二条【账户和信息安全】

Article 2) Account and Information Security

2.1

您可自行通过手机号码注册并开通此服务。您需根据本服务的功能需求提交您的姓名、性别，证件类型及证件号、手机号、国籍，邮箱等信息完成注册，或开通本服务。您授权和睦家医疗在法律规定的范围内保存以上记录，以供向您持续性地提供和推广优质服务。您同意：

  • 2.1.1 按照和睦家医疗的要求准确提供和更新您正确、最新及真实完整的身份信息及相关资料。若和睦家医疗有合理理由怀疑您提供的信息或相关资料错误、不实、过时或不完整的，本公司有权暂停或终止向您提供部分或全部本服务。本公司对此不承担任何责任，您将承担因此产生的任何直接或间接支出。
  • 2.1.2 您应当准确提供并及时更新您提供的联系方式，以便本公司与您进行及时、有效联系。您应完全独自承担因通过这些联系方式无法与您取得联系而导致的您在使用本服务过程中遭受的任何损失或增加任何费用等不利后果。
  • 2.1.3 若您为个人用户，您确认并已经知道，您通过身份证实名注册的手机号码及真实身份信息将会自动关联到您的病历号，用于使用户睦家医疗提供的在线自助服务，以及用于之后医院在需要时能联络到您的联系方式。
  • 2.1.4 为了您的信息安全，手机号一旦关联病历号，将不能自行在线更改，你必须到和睦家的医院前台验证身份，并由医院前台工作人员帮助您完成更改。
  • 2.1.5 若您授权其他人可以您查看您的个人信息，医疗记录和账单，并在和睦家医疗的系统中预留了被授权的人的手机号码作为联系方式，被授权人将可以通过在线自助服务查询你的以上信息。
  • 2.1.6 若您作为未成年人或无民事能力人的监护人在系统中预留了本人的手机号码，你将可以通过在线自助服务查询到未成年人或无民事行为能力人的以上信息。

2.1

You may register and activate this online software service through your mobile phone number. To access online services, you must accordingly submit your name, gender, ID type and ID number, mobile phone number, nationality, email address and other relevant personal information according to the functional requirements of this online service in order to complete registration. Through this agreement, you hereby authorize United Family Healthcare to keep the above records within the scope of Chinese law as required for all hospitals in China for the continuous provision and promotion of quality health care services to you. You further agree to:

  • 2.1.1 provide your true identity with all related accurate and up-to-date information in accordance with registration at the company. The Company reserves the right to suspend or terminate the provision of some or all online and offline services to you if it has reasonable grounds to suspect that the information or related information you provided is incorrect, untrue, outdated or incomplete. The Company does not assume any responsibility for incorrect information, intentional or otherwise, and you will bear any direct or indirect expenses arising there from.
  • 2.1.2 accurately provide and update all contact information you provide when any change is made so that the Company can contact you in a timely and effective manner. You are solely responsible for any loss or any costs incurred by you in the use of online or offline Services due to the Company's inability to contact you through the means of contact you provide.
  • 2.1.3 confirm and agree here that, as an individual user of this online service, your mobile phone number and true identity information associated with your legal identification will be automatically linked to your United Family Healthcare Medical Record Number (MRN), which will enable the Company to provide you and those bound to your account whose information you provide, with online self-services, including updated contact information by which the Company may contact you as needed.
  • 2.1.4 protect the safety of your personal information by agreeing that, once a given mobile phone number is associated with a Medical Record Number (MRN), you will not be able to change it online. In order to change this information, you must go to the main reception desk of any Company facility and verify your identity, so that the hospital reception staff can then help you to complete the change.
  • 2.1.5 the clear understanding that if you authorize other individuals to div your personal information, medical records, billing records, by attaching their mobile phone number to your account and proceeding with all online authorization procedures, that the authorized person will be able to check a range of your personal information through this online self-service platform and that you may have certain access to their personal information as well.
  • 2.1.6 the clear understanding that if you authorize by inputting the mobile phone number of a legal minor or a non-legal guardian in the online self-service platform, then you will be able to access the above information of the minor or non-legal guardian through online self-services, and the minor or non-legal guardian may also have certain access your information as outlined above.

第三条【本服务的使用】

Article 3) Use of This Service

3.1

您不得利用本服务实施下列任一行为或制作、上载、复制、发送如下内容：

  • a) 冒用他人名义使用本服务或电话号码与身份证号
  • b) 侵害本服务系統

3.1

You may not use this online self-service software to perform any of the following acts, or to create, upload, copy, or send the following content:

  • a) willfully using this service, authorized telephone numbers, or identification numbers in the name of another individual or individuals
  • b) willfully illegally infringing on the stated general good use of this service

3.2

您不得利用本服务实施下列任一行为或制作、上载、复制、发送如下内容：

  • a) 从事其他违反国家法律、法规、规章及政策法令的行为，或其他违反本协议的行为
  • b) 反对宪法所确定的基本原则的
  • c) 危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的
  • d) 损害国家荣誉和利益的
  • e) 煽动民族仇恨、民族歧视，破坏民族团结的
  • f) 破坏国家宗教政策，宣扬邪教和封建迷信的
  • g) 散布谣言，扰乱社会秩序，破坏社会稳定的
  • h) 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的
  • i) 侮辱或者诽谤他人，侵害他人合法权益的
  • j) 含有法律、行政法规禁止的其他内容的信息

3.2

You may not use this online self-service software to perform any of the following acts, or to create, upload, copy, or send the following content:

  • a) engage in any other acts that violate Chinese national laws, regulations, policies, or take any actions that otherwise violate this agreement.
  • b) any content that goes against the basic principles established by Chinese national laws and the Constitution
  • c) any content that endangers national security, reveals state secrets, subverts state power, and/or undermines national unity
  • d) any content that damages national Chinese honors and interests
  • e) any content that incites ethnic hatred, ethnic discrimination, and/or undermines national unity
  • f) any content that undermines national religious policies or that promotes cults and feudal superstitions
  • g) any content that spreads rumors, disrupts social order and/or undermines social stability
  • h) any content that serves to spread obscenity, pornography, gambling, violence, murder, terror in any way, or that assists in promoting such content
  • i) any content that insults or slanders others, or infringes on the legitimate rights and interests of others
  • j) any information containing other content prohibited by Chinese law or administrative regulations

3.3

本公司有权基于业务调整或风险管控的需要，在不预先通知情况下暂停、中断或终止向您提供本服务。

3.3

The Company reserves the right to suspend or terminate provision of service to you without prior notice based on any perceived business risk or for business adjustment purposes based on your non-compliance with above or for other reason whereby the Company's business may be perceived to be harmed or at risk.

第四条【不可抗力及其他免责事由】

Article 4) Force Majeure and Other Exemptions

4.1

在使用本服务的过程中，可能会遇到不可抗力等风险因素，使本服务发生中断。不可抗力是指不能预见、不能克服、不能避免且对一方或双方造成重大影响的客观事件，包括但不限于洪水、地震、瘟疫和风暴等自然灾害以及战争、动乱、政府行为等社会事件。出现上述情况时，本公司将努力在第一时间与相关单位配合及时进行修复，但由此给您造成的损失本公司在法律允许的范围内免责。

4.1

During the use of this service, risk factors such as force majeure may be encountered, causing the service to be interrupted. Force majeure refers to objective events that cannot be foreseen, cannot be overcome, cannot be avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plagues and storms, and social events such as wars, turmoil, and government actions. In the above circumstances, the Company will try its best to cooperate with the relevant units to restore the online service in a timely manner. However any interruption, loss or damage the company causes you in such situations is exempted from legal action as permitted by law in such times of force majeure.

4.2

在法律允许的范围内，本公司对以下情形导致的服务中断或受阻不承担责任：

  • a) 受到计算机病毒、木马或其他恶意程序、黑客攻击的破坏
  • b) 电脑软件、系统、硬件和通信线路出现故障
  • c) 您操作不当
  • d) 您通过非本公司授权的方式使用本服务
  • e) 其他无法控制或合理预见的情形

4.2

To the extent permitted by law, the Company shall not be liable for interruption or obstruction of service caused by the following circumstances:

  • a) damage by computer virus, Trojan horse, or other malicious software program, including a hacker attack
  • b) failure of computer software or hardware systems and communications lines
  • c) improper operations caused by, or as a result of, use by you
  • d) your use of this online service in a manner not authorized by the Company
  • e) other circumstances that cannot be controlled or reasonably foreseen.
